The U.S. Government has implemented a program designed to assist homeowners across the nation to avoid foreclosure proceedings. It is called the Making Homes Affordable – Home Affordable Foreclosure Alternatives Program.
The general premise of this program is that it will assist clients that do not qualify for any modification programs – Government or Lender specific - to be able to avoid the nasty effects of foreclosure. It is also designed to assist clients that do qualify for Government or Lender specific modifications but cannot afford the terms of the new modification. It also has programs available to cover relocation costs associated with needing to move from the home.
In the state of Florida, you can almost be guaranteed that once you fall 6 months behind on your home loan, you will be issued and served with a Civil Summons/ Complaint for foreclosure.
Hiring an attorney at that point is a wise decision because they will be able to counter the complaint, and help you maneuver through the legal system to obtain a favorable result in the end.
Florida is a Judicial state for foreclosure. Most states are not. We are fortunate that things are done here the way that they are. As homeowners, we have more rights than the banks do. Most states are not that lucky.
Appearing in the news lately, is a bill that the state legislature is trying to pass taking away our rights as homeowners. They want to make Florida a non-judicial state for Foreclosures.
This was initiated by the banks and would be horrible for Florida homeowners. The banks basically would not have to go through the court system to foreclose on people, they will more than likely just be required to post an ad in your local paper advertising that the home is going to be auctioned off.
Fortunately, that bill was not passed. But that does not mean that it won’t surface again. If you have a chance to let someone know that you think that is a bad idea, take advantage of it.
No one knows what the future holds. So many people never think that they would potentially face foreclosure, but it can happen. If that bill were to ever come back around and pass, it would make our options for help very limited if we were ever facing that type of situation.
Our lawyers understand what it takes to defend a foreclosure action in court. You can let the legal system work for you in the foreclosure. The banks lawyers know that the only easy victory is from those home owners who do not defend themselves.
